Pre-Marital Agreement

A pre-marital agreement, or sometimes referred to as an antenuptial agreement, is an agreement between prospective spouses who are contemplating marriage. Antenuptial agreements usually address issues of spousal support and the disposition of premarital and postmarital property in the event of divorce. In order to create a valid antenuptial agreement in Minnesota, each party must (1) fully and accurately disclose his or her debts and assets to the other, and (2) have the opportunity to consult with legal counsel of their choice. The antenuptial agreement must be in writing and must have been completed before the solemnization of the marriage to be enforceable.
